I can't make this any simpler...clearly not simple enough for the simple among us...but I will try.

"Take the guns, then go to court" is a direct violation of the Constitution, in various ways.

"Go to court, then take the guns" is not.

The second example is called "Due Process"...the first example is called "Gun Grabbing".

Is this that hard?
