For the long time visitors to the site, you may remember pictures of our eventful trip up the Alcan in the middle of a May snowstorm in which the wheel fell off our Blazer just a short time after a wheel rotation was performed during a service.

Well, after a mediation hearing last June, my big day in court came yesterday. Kind of anti-climactic, the owner of the dealership never showed so the Judge entered a judgement of just over $2500 on our behalf to cover our costs.

Happy we are to finally see this come to an end (assuming they pay) ... I guess like fishing, persistence pays off!

Since I still get asked about it from time to time, I thought I'd pass along what appears to be the end of the story ...

Bob glad to hear things went well for you. I am in the same type of problem right now. Had a new 350 put in my truck. when they did so they messed up up my transmission. Did not install it right, 2 qt's low all this made me have to get my tranny rebuilt. off to small claims court I guess.

From someone who has gone to small claims court (and won), let me congratulate you and then tell you that the fight has only begun. Winning in small claims court and then collecting your judgement are two different stories. There really is no power to collect. If the losing party doesn't pay, you'll have to hire a lawyer and start all over again - and probably have to transfer it to civil court!

If I remember right years ago I had to take a person to small claims court concerning damages to my car, well, T.V.hosts, let me tell you, you are absolutely right. As long as the person makes an effort, ANY kind of effort, and yes, I`m talking $1.00 that`s right, $1.00 a month that is constituted as an effort and there nothing no-one can do about it. Me, I finally said to hell with it and went about my business.

If your claim is against a dealership in WA what I did when I won a claim is.

1. find out what bank they deal with. I called the act dept and said I was going to buy a car and wanted to get a certified check from the same bank.

2. the court will allow you to freeze and demand payment from that bank.

the bank has to give up the amt as long as it does not exceed the amt of judgement.

I did this over 10 yrs ago and it worked then with little trouble.

The other thing you can do is file in the next higher court and place a lien on the property of that individual. You may not get your money now, but he can't sell until he setttles lien.

Best thing is to contact the court you won in and ask for their publication on what to do after you get your verdict... or something to that effect.
