A reminder for the USACE - it is now January 2021 which is the month you set as a target for a decision on WDFW's permit application for the ramp at Point No Point.

Just keeping it on the radar after over seven years.........

They will probably wait until after 1/20. New administration may weigh in.

Given the timing that is a concern. Fortunately given our system there is an administrative process available to appeal a negative decision before having to take it to Federal court.

After over seven years just the issuance of a decision will be moving this off dead center (effectively having been an informal denial).

That is a good point. If they never actually make a decision, it is hard to appeal.

They'll deny it, I suspect.

I'd like to believe that if the Corps was going to deny it they would have done so much sooner. The scary part is if it is denied the Corps will have set an extremely high bar for establishing a de minimus argument

Hopefully the Corps will grant the permit and if the Suquamish tribe feels strongly they can take whatever action they deem appropriate.

I think that they will try and avoid any direct challenge to the Tribes. There is so much tribal involvement and issues out there, like the pipeline in the Dakotas, that the Feds really aren't sure how to proceed.

If that is truly their paralysis the best thing for them would be a decision with a very clear, rationale basis. Tomorrow is work day 1 for them in January. The clock is ticking.

Since we're now in the habit of printing and handing out money why don't we just print an extra Trillion and buy out the onerous parts of the treaties so the tribes don't have so much leverage on how we operate in our own country {;>)

In the long run even at that price it might still be a good deal - but you have to have both a willing buyer and a willing seller and I doubt you would find a seller.
