In WA, I believe that is around 2 ounces (I think it is actually something like 54 grams). Getting caught with even the tiniest amount would show on the charge as "less than 2 ounces". My guess is that he didn't have anywhere near that amount. But I do bet it was good if he seriously thought he was going to cash a $360 Billion check.

If it's divided up they can still hit you with intent to distribute, which is a felony.
