I don't have a problem with his release. He was likely a young punk when he was convicted. He's done enough time for him to figure out how to STAY out. Let him get a job and pay taxes like everybody else, instead of costing us to feed and house him. if she has to release him then she should have at least sent him to oakland

The economy is marvelous, all loans are paying on time at my bank, and I've been fishing three days every week since November. I guess everything else is going so good, I only need to point out what I see is wrong. So you are saying that this governor who has mishandled her govt, gutted school funding, lied about the state of State finances during here campaign, and now lets a career criminal free gets a free pass because there were others below her that made decisions leading to this? She signed the budgets, she signed his clemency. It all starts at the top. Only time will tell for Mr. Dozier, but he has basically been in "crime school" for the past few years and has probably earned his master's degree. I wish him the best, but I have a very bad feeling about this.

i think that cutting school funds will cause more kids to drop out of school and more people in prison so either spend money on school teaching more kids work related skills or they will they will learn on the street.

Just like virtually every other context, you can spend a dollar now, or save it and spend eight dollars later to fix it...there are large segments of our electorate who would rather do it that way.
Throw all the knuckleheads in jail and throw away the key...and pay for it with your tax dollars forever...or pay a few dollars now to help make the criminals a functional part of society's taxpayer base.

So is the answer to give them all the counseling, medical care, education, housing, food, clothing that they want so they don't have to work for anything worth while? Just because some rat made bad decisions we get to pay for everything they want or need. That's just wonderful. How much money has to be spent on career criminals to make them stop making bad decisions? Although this is a serious subject, I cannot help but get a chuckle when Aunty M comes off as the bleeding heart liberal in a discussion.
As far as this 3-strikes criminal, if his 3 crimes are purse snatching from old ladies, that's an easy one in Salmo's justice system: kill him. Even if he can be rehabilitated, why should we bother? A well balanced justice system contains a good measure of both Old and New Testament revenge and compassion.
Having ample prison space should never be a problem. The problems are the laws requiring resorts for prisons. A really good prison should consist of a large 80' deep hole in the ground with no cover and the upper perimeter surrounded by razor wire. It would be crowded, dangerous, and when it wasn't either of those, it would be damned uncomfortable. If all prisons were like that, it wouldn't be unusual nor cruel unless they were being horsewhipped while in the hole. Vocational training and opportunity and education should be options earned for good behavior in the hole. Everyone sentenced goes in the hole until they demonstrate it's worthwhile for society to provide them with education and vocational opportunity.
And the surest cure for recidivism is to kill repeat offenders. It's the positive deterrent to a continued life of crime.
Oh, and in case this description is too vague, horse theft should still be a capitol crime, along with gang membership - I'm sick of their fvcking graffiti everywhere. Anybody flashing gang signs should simply be shot on sight, improving the efficiency of the justice system.
How's that from this liberal?

It's only not legal because certain laws make it so. Revise the laws. My position has nothing to do with religion (Muslim comment) nor communism. The very basis of social function is security. Humans are social animals, but the number one reason for forming social units beyond a few friends and family is security. Society's number one function is security. It isn't the only reason for its existence, but it's the primary one. In order to promote security, society should focus on the social unit, not the disfunctional (criminal) unit. Criminal activity is a threat to security, so society owes it to itself to protect itself from criminal activity - by whatever measures it finds most effective and, here's the rub, socially acceptable.
My premise is that too many in society have come to not accept highly effective measures that promote security. (The philosophical correlary is that we've gotten what we deserve then.) However, I'm at ease with the notion of prisons being primitive storage grounds that have both harsh social and physical environment. There's nothing inherent in the social order about providing 3 hots and a cot, not to mention wall to wall carpeting and color TV, to those who have demonstrated they are a risk to security. It's within the scope of natural and logical consequences that those who violate society expose themselves to significant personal risk.
While there are many causes of crime, like disadvantaged social background, and lately even unemployment among educated and ambitious people, a continuing cause of crime is that crime pays. Well, it doesn't always exactly pay, but when you have to be convicted of stealing more than 6 cars to serve jail time, lack of adverse consequence is a form of payment, etc. And that is clear evidence of a society choosing not to protect itself, and therefore failing its fundamental role.

Good points Aunty, I agree with you about crime and punishment laws needing adjustments. What strikes me odd is the folks clamoring to lock up all career criminals, are the same people complaining about higher taxes. The simple fact remains, you can't lock up every criminal and expect your taxes not to go up. To think otherwise just shows how utterly disconnected some people really are.

My novel prision idea isn't about barbarism or cruelty. It's about cost containment. While possibly bordering extreme by contemporary standards, society doesn't owe convicts comfortable accomodations. Unheated and out in the weather is in fact survivable; the homeless do it all the time.

Sentences in the pit should be proportionate to the crime. The worse the crime, the longer the sentence. But it's still the pit. However, in deference to Aunty's valid points about rehab, vocation, and education, this system would offer that opportunity to convicts who earn it. But they have to earn it; no free lunch.
As for your Iranian example, it's not relevant here. Adultery is legal in the US, tho frowned on by most folks. Serial monogomy is the popularly accepted relationship model here.
I'm a bit shocked. I thought everyone would like my idea for a cost effective prison system.

I wish I could remember the landmark study done in the 40's, with a follow up study done 10 years later, that determined what percent of the population is responsible for "hard core" crime. Basically, a small percent of society is responsible for most serious crime. The following article is really good, I hope all of you read the whole thing. I had several traffic tickets in the past but I have always paid my ticket/fine in whole and on time. I doubt those count as 'Interactions with the court system".
So since it would take felony convictions to qualify for the 3 strikes system, who cares if they were automobile (traffic) related. The fact is, it is still 3 felonies. Like already stated before, I doubt the only crimes he ever commited were the ones he was convicted for, it just happends to be the only times he was caught.

Except for one thing... the felonies he committed are apparently no longer part of the 3 strikes felonies used to sentence life in prison. If he committed those same felonies today, he would not have triggered the 3 strikes law.
Sooo, no conjugal visits? CRAP!

So when laws or sentencing guidelines change, does the legal system routinely adjust inmates sentences to meet the new criteria?

I think voting should fall under three strikes. All Bush voters have two strikes. Better be good from now on.

If you can't do the time don't do the crime. Does that apply to felony drunk driving? Should we lock repeat offenders up that have had 3 convictions for DUI, for the rest of their lives???? Very few people beat alcoholism. Yes, they should be removed from the playpen.
