JCT Confirms Failure to Comply with Democrats’ Mandate Can Lead to 5 Years in Jail

Today, Ranking Member of the House Ways and Means Committee Dave Camp (R-MI) released a letter from the non-partisan Joint Committee on Taxation (JCT) confirming that the failure to comply with the individual mandate to buy health insurance contained in the Pelosi health care bill (H.R. 3962, as amended) could land people in jail.
The JCT letter makes clear that Americans who do not maintain “acceptable health insurance coverage” and who choose not to pay the bill’s new individual mandate tax (generally 2.5% of income), are subject to numerous civil and criminal penalties, including criminal fines of up to $250,000 and imprisonment of up to five years.
In response to the JCT letter, Camp said: “This is the ultimate example of the Democrats’ command-and-control style of governing – buy what we tell you or go to jail. It is outrageous and it should be stopped immediately.”
Key excerpts from the JCT letter appear below:
“H.R. 3962 provides that an individual (or a husband and wife in the case of a joint return) who does not, at any time during the taxable year, maintain acceptable health insurance coverage for himself or herself and each of his or her qualifying children is subject to an additional tax.” [page 1]
“If the government determines that the taxpayer’s unpaid tax liability results from willful behavior, the following penalties could apply…” [page 2]
“Criminal penalties
Prosecution is authorized under the Code for a variety of offenses. Depending on the level of the noncompliance, the following penalties could apply to an individual:
• Section 7203 – misdemeanor willful failure to pay is punishable by a fine of up to $25,000 and/or imprisonment of up to one year.
• Section 7201 – felony willful evasion is punishable by a fine of up to $250,000 and/or imprisonment of up to five years.” [page 3]
This used to be America. It's not any more!!!

Failing to pay your income taxes is a criminal offense, so if you don't pay the surcharge, you are committing a crime.
Vastly different than "If you don't buy insurance you go to jail"...but doesn't sound nearly as imflammatory or scary.

Todd Todd, suppose you pay your owed income taxes but refuse to pay the surcharge. Is it then still a crime? Unlike some of the "wingnuts" I'm all for some targeted reforms of healthcare. I do oppose the current House bill because it has elements that take it too far to the left and on track for a single-payer system in this country. Try this analogy: Have you ever played pool? You know; gone out with some close fishing buddies one night for a little relaxation to a pub where you down a few beers,play a little game of pool for money,talk trash and bash wingnuts? In your experience, have you ever had a night where you just couldn't make a shot to save your life and your hard-earned dollars? Your problem was probably because you weren't looking straight down the stick. You were probably looking too far to the left of the stick......  Same with healthcare. Quit trying to drag this all the way to the left and get some middle-of-the-stick reforms that are less govt and more market-reform minded.

Todd, to some it may seem I was once again changing the subject and posting something irrelevant. Others will see that I quoted you and asked a pertinent question. That I also expounded on the topic with the pool playing analogy will only be apparent to those who have witnessed your pool playing prowess.....or lack of same......

Hard to believe it's true but a lib mentioned GOP and racist in the same sentence. Wow! That's a first....  One of those House seats the dems picked up was by a 30 year career govt teat sucker which is the base of those Dems.....  His 53-47% win was far less than Tauscher's (who he replaced) 65-31% in the last election. Pretty dismal when you consider he had a 18 point registration advantage....

A win is a win, as they say. What about the GOP though, I mean, 750k into a race where their candidate endorses the Dem, and the wingnut loses a seat that the GOP has had for well over 100 years. I'm sure it's good news for John McCain and the GOP though............ Repuglycans simply cannot win special elections, the one on one of elections. 5 in a row..................

Non-Dems got 51% of the vote in that special election. No telling what the results would have been without Scuzzyfloozie on the ballot.
Hoffman runs again as the only R on the ballot in '10 and wins. Book it!
But what does this all have to do with healthcare and how well Todd shoots pool?

Th Dems got one more vote on the yea side. Dede by all accounts was a typical NY moderate R in the Rockefeller mold, a vanishing species on a number of counts. Sh could have, and probably should have won, Hoffman................never had a chance, regardless of the crowing the talking heads on FOX did. just one more example of where Fox is wrong, again.  Hoffman was, and continues to be an idiot with zero knowledge of local issues. He had to bring in help, in the form of 'Im a Dick' Armey to go to a newspaper editorial board meeting, where Armey tried cover up Hoffman's abject idiocy, by pointing out his own............
