I just wouldn't call defending GWB's actions the same as giving a wiretap order, it would have been rediculous and selfish to deem wiretaps unconstitutional if that was to allow the US to be liable for the past administrations actions that were "legitimate" under the Patriot Act (and please lets not get into that whole thing).

That's what I meant by the Catch 22, if he did deem them unconstitutional the lawsuits would be lining up, when he didn't deem them unconstitutional, he is a hypocrite.
