The agency depends on the time it takes the courts to move forward. In recent years the Willapa NT Commercials challenged the season set and it was nearly two years later ( making the point mute as the season was over and in the past ) that they got a unfavorable decision. Other examples exist I imagine but all revolve around WDFW's legal authority which they have very successfully utilized to use as a shield for many actions. A TRO would blow that mechanism apart at the seams and brother I would love to watch the fire drill that followed in the concrete palace in Oly, it would be epic!

That would be a memorable fire drill. The Tribes could claim Foregone Opportunity on all the fish (It's not our problem that you can't file a legal reg). Oh, it would be be fun.

Although it would be fun, it would also be counter productive to what the challenge hopes to accomplish in my humble opinion. Not to mention it would create a situation where sporties couldn't fish, and the tribes could.

The issue needs to be fixed for future fisheries, and for the recreational community to a meaningful part of that.

There needs to be consequences to WDFW for not complying with the law. Right now, as has been mentioned, the legal process is so extended that the seasons get set, they occur (as WDFW intended) and all you get is the same-old process.

If you are satisfied with the results (we do get to fish, some) then perhaps blowing up the process is not worth it. There is a short term risk of no fishing if the results of the illegal process are actually declared illegal. In the long-term, you get a legal/open process.

I doubt that WDFW will change the way they are doing business if there are not significant consequences for illegalities. "We'll talk to the tribes, we'll do better next time, trust us" eventually wears thin when nothing changes.
