i agree and if its found that the tribal wardens did nothing wrong dont be surprised when your fishing or hunting off a reservation when a tribal warden stops and puts you in handcuffs and holds you for 2 hours because he thought you were doing something wrong, there will be nothing you can do about it.

The day they start pulling that $hit on a regular basis is the day that people start dying... on both sides...

Damage hunts put meat on the table. If you don't like them, don't apply.

You bet the fawk there is something I can do about it. Physically, if they have the jump on me I'll be compliant, but verbally I'll be the biggest pain in the ass they ever have dealt with. I'm on my phone, I'm recording the contact, I'm gonna respond to their verbal judo with a bit of my own. These assholes were wrong, plain and simple. THEY HAVE NO JURISDICTION OVER A NON TRIBAL PERSON 10 MILES AWAY FROM THEIR RESERVATION.

Game, set, match.

Of course, the god damned apologist democrat administration will probably sweep it under the rug.

I doubt this one is just going to go away. I agree that it looks like the LE guys were dead wrong in many areas....starting with the alleged guns-drawn confrontation....and I suspect that the Brinnon family involved in this mess will not go down quietly.

I don't think I would call it "alleged" when there are pictures of them with the guys on their knees with hands up and the AR-15 pointed at them.
I hope the family pursues this to its fullest extent.

Doesn't sound to me like you've ever been short on food. How do you know these people weren't providing for their families by putting meat on the table? After all, that is the point of hunting, is it not? What difference does it make if the elk so-happened to be by the water's edge? They aren't used to being shot at, so they didn't care if they were cornered. Speaking of which, I came back last Thursday on a mule deer hunt in central Idaho where they are not at all used to being hunted, let alone seeing humans. I located a group of about 12 does and 3 bucks. They all knew I was there, but didn't care because not one of them had probably ever been shot at before. I dropped a buck at about 70 yards. Was this not sporting because they didn't run from me?

Bottom line: They drew a tag and filled it. It was legal. They now have elk meat.

The newspaper article mentions that the "officers" were working on their "usual and accustomed" land (Boldt language).

Here's a question....Are the "usual and accustomed" boundaries mapped somewhere? I've never been privy to such information, and now it seems to be an important piece of information that all should know.

Anyone have such a map?

I have seen maps that cover each tibes fishing area. I am sure the state(WDFW, AG) have maps for the "ceded area". Note, too, that there are a number tribes that are trying to get approval to unt outside their U&A/ceded area.

Here's a link to the Point No Point Treaty. It includes a description of the area covered.

Here is a map to the treaty hunting/fishing boundaries in washington state :
http://wdfw.wa.gov/hunting/tribal/treaty_history.html

You have to see what treaty the tribe belongs to then look at the map which is color coordinated.

The tribe we were talking about in this issue can hunt some of the GMU's the following counties: Clallam, Jefferson, Kitsap, Mason, and Grays Harbor. So their "patrol area" is pretty big

They need to press trespassing charges against the tribal officers, as they had no permission to be there.

what pisses me off about this whole mess is that everybody is out to prove that they are right... If whoever is in the wrong would just man the F%#k up and say "I'm sorry, I screwed up", this whole F'n deal would probably be over...

The right of taking fish, at all usual and accustomed grounds and stations, is further secured to said Indians in common with the citizens of the territory…together with the privilege of hunting, gathering roots and berries, and pasturing their horses on open and unclaimed lands.

I guess the biggest issue I have with the whole thing is......the hunters were legal.........LEGAL

Nobody deserves to be treated like a fking criminal without good reason.

So what/where the fk is the Good Reason???????

I'm a big defender of LE, but not this time......this is just over the top STUPID!

When this is all done, I hope to Hell that the badged buffoons are tossed out of enforcement on their ears. Protect and Serve my ass.
