The use of the Interstate Commerce clause to move that pile of garbage out was a real leap and the Supreme Court will have to settle it. The federal government can not compel you to buy a product, they can tax your ass to fund a program ( Medicare / Medicaid / Social Security ) to provide a service.

That said if they passed a single payer program ( say expanded medicare ) funded by taxes that could or could not be utilized at ones own will, it would have passed muster.

Judge was right, congress is a bunch of sniveling cowards for not facing up to the issue. The other side is the current system could not continue, all should have health-care, so they have to fix it.
