Maybe you and I read different articles. The Times article states the incident was initially investigated as a hate crime, and that the occupants of the car yelled at the guys walking, because they were white.

Not disagreeing with you on the hate crime aspect, though. If a white man gets charged with a hate crime because he mentions racial slurs, then the same treatment should go for a black man.
