Been in the works for some time now. This showed up on the CHEHALIS.NET thread back in the fall of 2015. Hi Everyone,
I want to alert you to an emerging issue in the Chehalis River basin. The Skokomish Indian Tribe has recently made a claim to “usual and accustomed grounds” on the Satsop and Chehalis rivers. That is, they are asking for fishing rights in the Chehalis Basin. They have scheduled a “meet and confer” with other parties to US vs. Washington, including other tribes, for November 4th. A meet and confer is usually a precursor to court proceedings and an opportunity for the parties to try and reach a settlement. At this time, we do not know the evidence for the claim. We aren’t sure they will present it to us on the 4th, as they may save it for court. We will know more after the 4th and should be able to give you a better update.
I’d like to say call for more information, but I really don’t have much to offer. This is going to be a wait and see for the moment.

If this actually goes through, it will be intersting how the treaty half is shared State and Chehalis (non-treaty tribe) feed off the non-treaty half of Chehalis Basin salmon. QIN's will have to cede some of the Satsop portion of their 50% Chehalis Basin salmon to the Skok's

According to Boldt, QIN needs to give up nothing. The Treaty Right is cumulative. If, after fishing, there are no Indian Share harvestable left upstream of the QIN fishery then there is no further Indian fishing allowed. Unless WDFW decides to give some NI fish to the Tribes.
I was involved in situations where a one tribe wanted WDF to shut down a downstream tribe so they (the upstreamers) could get some fish. That was beyond the State's authority. It was an intertribal issue. As will be any sharing between QIN and Skok if the courts allow the U&A expansion.

I would love to go but time makes it impossible. If someone makes it I would love to hear how it goes. I talked to someone in charge of this last year and he stated that the tribe was willing to work something out, but that some changes would need to be made and those changes were still being determined. I think that a bobber only fishery, at least in some areas, and maybe a closing for netting one or two days a week would take care of most of the issues. One thing that should be brought up was that during the one "bobber only" fishery, the tribe opened the river up for commercial snagging. I walked into a hole hoping to find some unmolested fish for once, only to find a tribal member wailing away with a treble hook. If the state does make changes to satisfy the tribe, this needs to be addressed.
Lastly, if no agreement can be made then pressure should be placed on the state to allow the issue to be challenged by individuals. The present situation involves the state shutting down the fishery and working with the tribe, with the state prosecuting violations; rather than forcing the tribe to prosecute and providing for a possible remedy in federal court. Past cases make this look like a slam dunk, but if the state refuses to allow review by the courts, nothing will happen. I am tempted to trespass and without a rod and try to get the tribe to prosecute. My gut feeling is that they would detain and issue a citation, but drop then charges if it goes to court- thereby preventing any chance for legal review of their claims.

I'm thinking its time for Grossman and RW to lead by example....."head to the river, during salmon season"......ladder, rod, eggs, floats, enjoy a few hours on this river, with some of many others that enjoy the peace and quiet of fishing a Pacific Northwest River.

Does anyone know why the plan to open the Skokomish got scrapped? I think the plan in the deleted article was to open it and prepare for a lawsuit? Did Ron Warren horse trade this idea for something else, or more likely just gave up on it? If you ask they will simply state that the Tribe would not agree to fishing and that they felt it was better to wait and continue negotiating. I believe this to be a straight lie. I talked to a biologist last year and he stated the tribe was willing to allow fishing if the state would make changes. He was sure that it would be open. I think that it was easier for the state to say they could not do anything than to actually make changes and try to enforce them. By blaming the Tribe the state gets to walk away with doing nothing. The Tribe is keeping their mouth shut because they gain quite a bit by having us off the river. If I could make a meeting I would insist won getting an answer to this question. Was the tribe unwilling to open it this year under any terms? Did the Tribe put forth any proposals or suggests were put forth by the tribe that would allow it to be open. My guess is that if they are smart you will get an answer that claims ignorance on the actual negotiations.

This primarily an issue for the Federal Courts. There are maps (WDF had them) that shows the area ceded by each tribe (now their U&A). State can't really stop it unless they can go to Federal Court and show that the Skoks were never there.
As I mentioned before, the sharing is I/NI and QIN can cork the Skoks. The interesting hammer the Skoks have is that they are a NOF tribe and could hold up agreements until they get what they want in the Satsop. And, If QIN won't give it to them there will always be the NI side.
