I can't say I have followed this issue closely, or even at all really, but in reading Ryguys post, I found it interesting that the 4th Amendment horn is still being tooted, even if just a little.

Has anyone heard or read any rebuttals to the claim that such a program, if implemented, would be unconstitutional?

Last I read up on the subject, developing PC was one way to go about a legal search, but not the only. There are exceptions to the warrant requirement, and certain situations where PC is not required. DUI checkpoints for example. Most LE agencies, federal and other, have enabling legislation and/or case law that says safety checkpoints and other such inspections are legal as long as they subject to and administered based on a "reasonable regulatory scheme."


Defining reasonable? Well, I guess that is why the judges make the big bucks.
