While my buddy was hunting the late archery hunt with good success he made the cardinal mistake. He legally killed a cow elk. After he got over to her he noticed she had two arrows stuck in her. The one that killed her was his and the other had occurred sometime during the early season archery hunt or before. It was getting late and decided to butcher his prize. No phone on him and he did not know there was a requirement to call. After hours of work he headed back towards where he believed his truck was. When he got to his truck a man was standing there drinking coffee waiting in the rain. It was............... the man waiting for him. fridge He incurred multiple violations starting with unlawfully dispatching a wounded animal. He did not immediately notify the authorities as soon as he discovered it had been shot previously. It just gets uglier from there. He had shot a blacktail the day before legally and processed it in he field. He was in trouble for not leaving positive ID horns or nuts attached to the animal while in the field. They tested the meat from the skull cape at camp and it was the legally harvested blacktail. In the end he had thousands of dollars in fines and up to 4 years in prison coming, but the judge removed everything, but he still lost his sportsman's privileges. The state really needs to simplify our rules. You need to have a law degree to completely understand all the extraneous rules. slap flog beathead

even if he had a cell phone, chances are very high he had zero cell service at the animal.

how do they know the animal wasnt shot 5 minutes before your friend shot it? it happens... my uncle was hunting elk years ago, shot a nice 5 point bull, and went down to get it, he didnt know that there was another hunter down in the area, and the hunter shot the downed bull with his bow, when my uncle arrived, the guy said he killed it, my uncle said no you didnt, i shot it from 20 yards (in that range) away, and there was no arrow in it... they got into an arguement, and he shot my uncle in the chest with a .357... he lived, but never hunted again...

not leaving positive ID on an animal is his mistake tho, just like with fish, they want to know the sex and species in the field, which really isnt that big of a deal... if you fail to obey, they will do just as they did to your friend, and its not pretty...

sorry he lost his rights...

Yeah, I have a hunch your "buddy" was on the wrong side of the law a couple times before and the staters finally had a reason to tag him..

I know ignorance to the law is no excuse. He realized the cow had survived a previous bow injury after he shot it. The injury was NOT fresh. By his account the game warden treated him well, but had to investigate everything after that. The nuts or horns attached requirement for ID is for unprocessed animals in the field. The buck was neatly cut, boned, and wrapped in the cooler. I don't know i he left the tag in the cooler or on the handle. He hunts and harvests his game for his family. This isn't Joe Poacher were are talking about here. The warden even stood up for him in court. My buddy was at fault for dispatching/ harvesting a wounded animal without WDFW permission. As I mentioned before he his privileges and bow. The judge did not feel like he was poacher, but is teaching him a lesson in law. It is sad when we have so many rules that we need rules for the rules and everyone is treated as guilty until proven innocent. The whole thing stinks, but our WDFW aand RCWs need change now. What ever happened to common sense? Never experienced so much stupidity till I moved over the mountains. Just sayin.

I chalk it up to not understanding all the many rules and being a bit of a red neck. And he was told by the Judge to get his own representation. I think he chose the public defender. Again had they really had him had be in jail. At best they were following orders, but they cut him a lot of slack cause he understood he made a mistake after it was explained to him. If he chooses to hunt again I am sure he will try his best to memorize all the regs and not have this happen again.

Just what rules did the guy violate with the elk? I made a quick look through the rules and didn't see anything that says I have to call WDFW if I kill a previously wounded animal; if I kill it legally.

I can see some issues with the butchering in the field and taking only the meat.

Why was the agent waiting for him at his truck? Was it really late at night and somebody reported a poacher?

it sounds to me, that he saw a wounded elk wandering around during a drive, and decided to get rid of its misery per say, and dropped it.. and got caught...

what if when he saw it, and when he shot it, it was facing broadside, and the arrow was on the other side? he would never have seen it being previously wounded...the WDFW nor any judge would say otherwise, common sense rules that aspect..

animals also dont last long with arrows in them... after a week, if they make it, they wont be trotting around in the woods like nothing happened...

your buddy messed up and got nailed... sorry he lost his rights, but thats the rules of the game if you do stupid things...
