Back in the day, the rec (and all troll) were added as what were called "prior interceptions". An estimate of what that catch was so that allocations could be figured. It was an add-on to the pre-season forecast which actually consisted of escapement and net harvest of adult fish.

Managing generally dealt only with the "net run". The rec fishery would be modified only if there was an extreme departure from the PSF. Lots more fish might bring an in-river increase in bag limit and a definite crash could bring a closure of that same in-river fishery.

This management model assumed that one was fishing on runs returning with harvestable fish. In Hoh-v. Baldridge the tribe challenged closing their fishery for conservation (which was true) when there had already been an ocean fishery (sport and troll) on the stock that was in a conservation concern out there. Court ruled that the tribes can't be closed for conservation if it was fisheries by the NI side that caused or exacerbated to conservation problem. The burden of conservation was supposed to be shared rather equally.


We now have a balancing act wherein each side gets so many fish regardless of conservation status; the fish bear the conservation burden. This problem is the gift given us by Mixed Stock Fisheries.
